These Terms of Service ("Terms") govern your access to and use of the website at englishwithchristinah.com (the "Site"), our online courses and workshops, our application form, our informational materials, and any other services we provide (collectively, the "Services"). The Services are operated by Christinah Mulder, a sole proprietor doing business as English with Christinah, located at 138 E 12300 S, Ste C-1087, Draper, UT 84020.

By visiting the Site, submitting our application form, enrolling in a workshop or course, or otherwise interacting with the Services, you agree to these Terms. If you do not agree, please do not use the Services.

1. About the Services

We offer live, small-group online English-language instruction (including the "Advanced Academic English" 8-week cohort program), free informational workshops, and supporting written materials. The Services are educational in nature and are not a substitute for accredited academic instruction, professional certification, or official test preparation services offered by testing organizations.

2. Eligibility

The Services are intended for adults aged 18 or older. By using the Services, you represent that you are 18 or older and have the legal capacity to enter into these Terms. If you are using the Services on behalf of an organization, you represent that you are authorized to bind that organization.

3. Application and Enrollment

Enrollment in our paid courses is by application. You apply via our online application form (currently hosted on Google Forms). After you submit your application, we will review it and send you an email confirming acceptance and providing payment instructions, or declining your application or recommending an alternative resource.

We reserve the right to accept or decline any application at our sole discretion, including based on the fit between your stated goals and the program's design. Spots are limited. Cohorts have a minimum of 8 and a maximum of 12 participants. If a cohort does not reach the minimum, we may cancel that cohort and refund any payments received.

4. Payment Terms

Tuition is paid in full at the time you submit your application. Payments are processed through Stripe. At checkout, Stripe may offer third-party "buy now, pay later" options (e.g., Affirm, Klarna, Afterpay) that allow you to spread the cost over time; eligibility and terms for those options are set by the provider, and any repayment obligation is between you and them. Christinah Mulder d/b/a English with Christinah receives the full tuition up front regardless of which method you choose.

By submitting payment, you agree to Stripe's terms. We do not store your full card number; we receive only a transaction confirmation, the last four digits of your card, billing country, and a transaction ID.

All prices are in U.S. dollars and exclude any taxes that may apply in your jurisdiction. You are responsible for any such taxes.

5. Refunds, Cancellations, and Deferrals

We want you to feel confident enrolling. The refund policy is:

Recordings are provided solely for your personal review. Sharing, reposting, or redistributing recordings is prohibited (see Section 7).

7. Intellectual Property

Our materials. All course content — including the curriculum, slides, worksheets, the Academic Vocabulary System, the AI Practice Guide, recorded sessions, written feedback, and any other materials we provide — is the intellectual property of Christinah Mulder, protected by U.S. and international copyright. Upon enrollment, we grant you a personal, non-exclusive, non-transferable, non-sublicensable license to access and use these materials for your own learning during and after the program. You may not copy, redistribute, sell, publicly post, or use these materials to teach others.

Your work. The original writing and other content you produce in the course remains your intellectual property. By submitting work for feedback, you grant us a non-exclusive, royalty-free license to read, comment on, and discuss your work within the cohort context.

Anonymized examples. We may use anonymized excerpts of student work (with all identifying details removed) as teaching examples in current and future cohorts and in our marketing materials. If you do not wish your work to be used for these purposes, even anonymously, please tell us in writing and we will honor that request.

Recordings. Live sessions are recorded for the benefit of the cohort. Recordings, like all course materials, are subject to the personal-use license above. You may not record sessions yourself, distribute recordings provided to you, or use them outside the scope of your own study.

8. The Site

You may use the Site for personal, non-commercial purposes consistent with these Terms. You may not (a) attempt to gain unauthorized access to any portion of the Site, (b) interfere with its operation or security, (c) scrape or copy substantial portions of the Site for commercial purposes, or (d) use the Site to harass, defame, or violate the rights of others.

9. Acceptable Use

By participating in the Services, you agree to:

We reserve the right to remove participants from a cohort, without refund, who materially violate these expectations after a warning, or who engage in conduct that endangers other participants.

10. Communication

Once you submit an application or enroll, we will send you transactional emails related to your application, enrollment, and course logistics (acceptance, payment confirmations, schedule reminders, materials, etc.). You may not opt out of essential transactional communications related to a course you are enrolled in. Marketing communications are sent only to those who opt in via our application form's marketing checkbox, and you may unsubscribe at any time.

11. Disclaimers

The Services are provided "as is" and "as available." While we dedicate substantial effort to designing a high-quality program, we make no guarantees about specific outcomes, including but not limited to:

Outcomes depend significantly on your individual effort, baseline proficiency, and external circumstances. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

To the maximum extent permitted by law, in no event will Christinah Mulder, English with Christinah, or any of our agents or service providers be liable to you for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of opportunity, or loss of data, arising out of or in connection with the Services or these Terms, even if we have been advised of the possibility of such damages.

Our aggregate liability for any direct damages arising out of or relating to the Services or these Terms will not exceed the amount you paid us for the Services in the twelve (12) months preceding the event giving rise to the claim. If you have not paid us, our liability is limited to one hundred U.S. dollars (US$100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. To the extent your jurisdiction does not allow such exclusion or limitation, the above limitations apply only to the maximum extent permitted by your local law.

13. Indemnification

You agree to indemnify and hold harmless Christinah Mulder and English with Christinah from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of (a) your use of the Services in violation of these Terms, (b) your violation of any third party's rights, or (c) your violation of any applicable law.

14. Third-Party Services

Some parts of the Services rely on third parties — including Google (forms and workspace), Cloudflare (DNS, email forwarding, and website hosting), Stripe (payments), and Zoom (live sessions). Use of those third-party services is also subject to their own terms and privacy policies. We are not responsible for the acts or omissions of third-party providers, except as required by law.

15. Changes to the Services or Terms

We may update these Terms from time to time. If we make material changes, we will post the revised Terms on this page, update the "Last updated" date, and (where required) notify enrolled participants by email at least 30 days before the changes take effect. Your continued use of the Services after the effective date constitutes acceptance of the revised Terms.

We may also change or discontinue any part of the Services at any time. If we discontinue a paid course before it is delivered, we will refund any prepaid amounts attributable to undelivered sessions.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Utah, USA, without regard to its conflict-of-laws principles.

Informal resolution first. If you have a concern, please contact us at hello@englishwithchristinah.com before pursuing formal action. We will work in good faith to resolve the issue within 30 days.

Forum. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Salt Lake County, Utah. You consent to personal jurisdiction and venue in those courts. Small-claims court remains available for qualifying disputes.

No class actions. To the extent permitted by law, all disputes will be resolved on an individual basis. You and we waive any right to participate in a class action, class arbitration, or representative proceeding.
